Another legal issue related to the conflict and to relations between Georgia and
Russia is the Russian so-called “passportisation” policy, meaning the mass conferral of
Russian citizenship and consequently passports to persons living in South Ossetia and
Abkhazia, where a vast majority of the population are now carrying such Russian
passports. While Russian citizenship had been conferred in individual cases already at an
earlier point in time, the new Russian Law on Citizenship which entered into effect in the
year 2002 regulated in its articles 13 and 14 admittance to Russian citizenship in a
simplified procedure and thus opened broader avenues soon to be exploited by thousands
of new applicants from South Ossetia and Abkhazia. One of the essential requirements for
other states to be obliged to recognise such conferrals of citizenship under the terms of
international law is, however, that there must be an adequate factual connection between
the applicant and the receiving country – in this case Russia – and which must not be
arbitrary. This could be for example family connections, long-time residence and extended
government or military service. In addition, an explicit consent of the home country is
required. Georgian law, however, does not recognise dual citizenship. Former Soviet
citizenship is not considered sufficient grounds, since this status had already been
translated into Georgian citizenship at the time of independence. Given these requirements,
only a limited number of such conferrals can be deemed as legally binding under
international law. The vast majority of purportedly naturalised persons from South Ossetia
and Abkhazia are not Russian nationals in terms of international law. Neither Georgia nor
any third country need acknowledge such Russian nationality. Consequently, the persons
living in South Ossetia and Abkhazia who had first become Georgian citizens after the
dissolution of the Soviet Union continue to remain so irrespective of “passportisation”
policies. They were still citizens of Georgia at the time of the armed conflict of August
2008, and in legal terms they remain so to this day unless they had renounced or lost their
Georgian nationality in regular ways. The mass conferral of Russian citizenship to
Georgian nationals and the provision of passports on a massive scale on Georgian territory,
including its breakaway provinces, without the consent of the Georgian Government runs
against the principles of good neighbourliness and constitutes an open challenge to
Georgian sovereignty and an interference in the internal affairs of Georgia.

"A total of 19 countries are planning to take part in this exercise, and it will take place according to plan. There are no complications in preparations for this exercise so far."

Latvia not to take part in NATO exrecises in Georgia
Latvia will not take part in the NATO military exercise in Georgia, which will take place from May 6 till June 1.
Airis Rikveilis, the head of the Latvian defense minister's office, told BNS that Latvia does not plan to participate in this exercise and the issue has ben been discussed with Latvian officials.
"The situation is that we cannot send any additional people there. The military exercise plan has already been approved and this exercise is not in the plan," he said, adding that the financial situation is not the reason this time.
NATO military exercise in Georgia will be held to promote cooperation between NATO and its partner countries. There will be about 1,300 participants from 19 countries, including NATO members and partners.
Russia has sharply objected the exercise, calling it a provocation.
Georgia is not a NATO member. In April 2008, during NATO Bucharest Summit, the alliance rejected the request of Georgia and Ukraine to issue the status of candidate countries to them, but underscored that both countries have a future in the alliance. Russia is against both countries joining the alliance.
The relations between Moscow and NATO deteriorated after the Russian-Georgian military conflict in August 2008.

BARVIKHA (Moscow Region), April 17 (RIA Novosti) - NATO's decision to hold exercises in Georgia next month threatens to complicate ties with Russia, the Russian president said on Friday.
The Cooperative Longbow 09/Cooperative Lancer 09 command-and-staff exercise, led by the Western military bloc, will be held from May 6 through June 1, and will not feature light or heavy weaponry.
"Such decisions are disappointing and do nothing to help restore full-level contacts between the Russian Federation and NATO," Dmitry Medvedev said.
He warned that Moscow "will be closely watching" the drills and "if necessary, make appropriate decisions."
Russian Foreign Minister Sergei Lavrov slammed on Thursday NATO's exercise plans, saying they could give the Georgian regime a sense of impunity, and raise tensions in the Caucasus region.
NATO said Russia is welcome to join its military exercises in Georgia, but from every indication, the invitation has been ignored by Moscow.
The drills are aimed at improving interoperability between NATO and partner countries, within the framework of Partnership for Peace, Mediterranean Dialogue and Istanbul Cooperation Initiative programs.
A total of 19 countries will be participating in the exercises: Albania, Armenia, Azerbaijan, Bosnia and Herzegovina, Canada, Croatia, the Czech Republic, Georgia, Hungary, Greece, Kazakhstan, Moldova, Serbia, Spain, Macedonia, Turkey, the United Arab Emirates, Great Britain, and the U.S.
Russian officials reportedly have claimed that Latvia and Estonia also have pulled out of the exercise in recent days. Such a move would have been surprising, given the Baltic states' traditional support for Georgia. But Georgian Deputy Defense Minister Giorgi Muchaidze told RFE/RL's Georgian Service on April 21 that none of the Baltic states had ever planned to take part.
"Latvia, Lithuania, and Estonia did not plan to participate in this exercise, therefore none of these countries could have canceled its participation," Muchaidze said. "A total of 19 countries are planning to take part in this exercise, and it will take place according to plan. There are no complications in preparations for this exercise so far."

Latvia not to take part in NATO exrecises in Georgia
Latvia will not take part in the NATO military exercise in Georgia, which will take place from May 6 till June 1.
Airis Rikveilis, the head of the Latvian defense minister's office, told BNS that Latvia does not plan to participate in this exercise and the issue has ben been discussed with Latvian officials.
"The situation is that we cannot send any additional people there. The military exercise plan has already been approved and this exercise is not in the plan," he said, adding that the financial situation is not the reason this time.
NATO military exercise in Georgia will be held to promote cooperation between NATO and its partner countries. There will be about 1,300 participants from 19 countries, including NATO members and partners.
Russia has sharply objected the exercise, calling it a provocation.
Georgia is not a NATO member. In April 2008, during NATO Bucharest Summit, the alliance rejected the request of Georgia and Ukraine to issue the status of candidate countries to them, but underscored that both countries have a future in the alliance. Russia is against both countries joining the alliance.
The relations between Moscow and NATO deteriorated after the Russian-Georgian military conflict in August 2008.
